General Guidelines

For Your Protection: Please do not give any personal information or your myTrack or myTrade passwords to anyone in the chat rooms. myTrack staff or its host representatives will never ask you for your password because we already have it safely tucked away. If anyone asks for your password, report this immediately to support@trackdata.com

ENERING A CHAT & CHANNEL SESSION AT MYTRACK WILL CONSTITUTE ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS CHAT AGREEMENT. IF YOU DO NOT AGREE TO ABIDE BY THESE TERMS, PLEASE DO NOT ENTER MYTRACK GENERAL CHAT OR ITS CHANNELS.

"Never talk to strangers"—Children and teens should be especially careful not to give anyone personal information about themselves (real name, phone, address, city, URL, age, gender, email address and etc.)

You are entirely responsible and liable for all activities conducted through your General Chat & Channel session. Listed below are some, though not all, violations that may result in myTrack terminating your Chat & Channel session. By using the myTrack Chat and Channels, you agree not violate any of these guidelines.

myTrack assumes no responsibility for the accuracy, currency, completeness or usefulness of information in any material posted public or channel areas of the service and it does not endorse any opinions or recommendations posted by members, nor does it give tax or investment advice or advocate the purchase or sale of any security or investment. You should exercise discretion and skepticism before relying on information in chat messages, since it may be incorrect or misleading. Members may pretend to be people that they’re not. Some may have bad intentions or may have bad information—so beware! You should make an independent investigation before making any major financial decisions, and if you rely on information posted by other members you do so solely at your own risk.

myTrack does not review, screen or edit all messages posted by members. Nonetheless, myTrack reserves the right to monitor or remove any information transmitted or received through the Service, or to terminate your membership and use of the Service, at any time, without notice, in our sole discretion. It is members’ responsibility to bring violations of the Terms of Use to the attention of myTrack or its chat Hosts on duty, although we do not guarantee any action based on such information. The following actions, among others, may result in termination of your membership priviledges to participate in the chat portion of the system.

  1. Harass, threaten, embarrass or cause distress or discomfort upon another myTrack Chat & Channel participant, user or other individual or entity, including the use of blatant expressions of bigotry, racism, hatred or profanity;
  2. Transmit, via myTrack Chat & Channel, any data or information that violates the basic laws of Copyright restrictions. This would include the transmission of any data, text, files, links, software, communication or other materials that myTrack considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable;
  3. Partake in any activity that causes a disruption in the normal delivery of the myTrack Chat & Channel service;
  4. Impersonate in myTrack Chat & Channels any person, including but not limited to, myTrack staff members, community leaders and hosts.
  5. Post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation that are in violation of Netiquette. This does NOT include one time or occasional references to any information source the member considers to be helpful in the investing learning experience. Any reference to a Website that is considered obscene by myTrack will be grounds for immediate chat suspension.

While the above guidelines may, in some cases, be subject to judgment it is myTrack’s intent to issue at least one warning in chat or by electronic mail when violations are detected, unless they are considered very serious and threatening to the chat service. Members must be aware, however, that such warnings will directly affect subsequent actions taken by myTrack for repeated violations.

Terms of Use

Users are solely responsible for anything contained in their Chat & Channel sessions under their ID(s). MyTrack does not verify, endorse or otherwise vouch for the contents of any chat or forum session. Users may be held legally liable for the contents of their Chat & Channel sessions, and may be held accountable if their chat or forum sessions include, for example, material protected by copyright trademark, patent, or trade secret law without the permission of the author or owner, or defamatory comments. Decisions rendered by myTrack chat Hosts may not always be final, since the member may appeal to myTrack staff, which has final authority on all decisions regarding the User Agreement.

myTrack Chat & Channel users may not upload or transmit any content to myTrack chat that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party. By submitting content to any chat room or forum, you automatically grant – or warrant that the owner of such content has expressly granted – myTrack the royalty – free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media technology now known or later developed for the full term of any rights that may exist in such content.

The user agrees to indemnify and hold harmless myTrack for any loss, liability, claim, damage and expenses (including reasonable attorneys’ fees) arising from or in connection with the contents of the user’s chat or forum session.

In the event that myTrack receives a complaint that the contents of a personal chat or forum session infringe intellectual property rights or otherwise are unlawful, myTrack shall request written substantiation of the complaint from the complaining party. For example, substantiation of proof of ownership in the form of a trademark, service mark, or copyright registration, may be requested and myTrack will take such steps that it believes to be appropriate under the circumstances, including, for example:

    1. Remove the session or post immediately until the dispute is resolved;
    2. Provide the member with contact information for the complaining party;
    3. Instruct the member to contact the complaining party to resolve the dispute;
    4. Inform the complaining party of our actions and ask it to work directly with user.
